Probate

Probate is the process of legally passing assets after death to the person’s heirs or devisee.  Probate may occur with or without a will. An “heir” is a person entitled to receive the assets of the person that died without a will.  This could be a son for example.   A “devisee” is a person entitled to receive assets because the will says so. The person assigned to handle the probate process is called a “Personal Representative.” During the probate process, the court will oversee the Personal Representative’s administration of the estate. Probate involves, among other things, gathering assets, paying debts and distributing property.
